Welcome to Simon Says Pet. These Terms of Service ("Terms") govern your access to and use of our website, and your purchase of any products from us. By accessing our site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our site or purchase our products.

Throughout these Terms, "we," "us," "our," and "Simon Says Pet" refer to Simon Says Pet, Inc., a Delaware corporation. "You" refers to the person accessing our site or purchasing our products.

1. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to purchase from our site. By using our site, you represent that you meet these requirements.

2. Products and Product Information

We make every effort to display our products and their ingredients, materials, and specifications accurately. However, we do not warrant that product descriptions, images, colors, or other content on our site are complete, current, or error-free. Actual products may vary slightly from images shown.

We reserve the right to limit quantities, discontinue any product at any time, and refuse any order at our sole discretion.

3. Not Veterinary Advice

Our products, website content, blog posts, videos, and educational materials are for general informational purposes only and are not a substitute for professional veterinary advice, diagnosis, or treatment.

Our supplements and consumable products are not intended to diagnose, treat, cure, or prevent any disease. Always consult your veterinarian before introducing new foods, treats, or supplements into your pet's diet, especially if your pet has a known health condition, allergy, or is pregnant, nursing, or taking medication. Never disregard or delay seeking veterinary advice because of something you read or purchased on our site.

You are solely responsible for monitoring your pet's use of our products and discontinuing use if any adverse reaction occurs.

4. Pricing and Payment

All prices are listed in US dollars and are subject to change without notice. Applicable taxes and shipping charges are calculated at checkout. We reserve the right to correct pricing errors, including after an order has been placed. If we cancel an order due to a pricing error, we will refund any amount charged.

Payment is processed at the time of order through our third-party payment processors. By submitting payment information, you represent that you are authorized to use the payment method provided.

5. Orders, Shipping, and Risk of Loss

An order confirmation does not constitute acceptance of your order. We may cancel or refuse any order for any reason, including suspected fraud, pricing errors, or product unavailability.

Shipping timelines are estimates only. We are not liable for delays caused by carriers, weather, or other events outside our control. Title and risk of loss pass to you upon our delivery of the products to the carrier. Claims for packages marked delivered by the carrier but not received should first be directed to the carrier.

6. Returns and Refunds

All returns and refunds are governed by our Return & Refund Policy, which is incorporated into these Terms by reference. Please review it before purchasing, as certain items, including opened products, toys, and beds, are not eligible for return.

7. Subscriptions

If you purchase a subscription product, you authorize us to charge your payment method on a recurring basis at the interval selected until you cancel. You may cancel at any time through your account or by contacting us, and cancellation takes effect for the next billing cycle. Charges already processed are governed by our Return & Refund Policy.

8. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

9. Intellectual Property

All content on our site, including our name, logo, product names, packaging, text, graphics, photos, videos, and designs, is the property of Simon Says Pet, Inc. or its licensors and is protected by trademark, copyright, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.

10. User Content and Reviews

If you submit reviews, photos, comments, or other content to our site or tag us on social media, you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, and display that content in connection with our business, including marketing. You represent that you own or have rights to any content you submit and that it does not violate any third party's rights.

We may remove any user content at our discretion. You may not submit content that is false, misleading, defamatory, obscene, or unlawful.

11. Prohibited Uses

You agree not to use our site to violate any law, infringe any third party's rights, transmit malware, scrape or harvest data, interfere with the site's operation, or attempt unauthorized access to our systems.

12. Third-Party Links

Our site may contain links to third-party websites, including our partner rescue organizations and the Simon Says Foundation. We are not responsible for the content, policies, or practices of any third-party site. The Simon Says Foundation is a separate legal entity, and donations to the Foundation are governed by its own terms.

13. Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, OUR SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMON SAYS PET, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Indemnification

You agree to indemnify and hold harmless Simon Says Pet, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of our products, or your violation of any law or third-party right.

16. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.

Before filing any claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days. Any dispute that cannot be resolved informally will be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, on an individual basis only. You waive any right to participate in a class action or class-wide arbitration. Either party may bring an individual claim in small claims court instead.

17. Changes to These Terms

We may update these Terms at any time by posting a revised version on our site. Continued use of the site after changes are posted constitutes acceptance of the revised Terms. The Terms in effect at the time of your order govern that purchase.

18. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Return & Refund Policy and Privacy Policy, constitute the entire agreement between you and Simon Says Pet, Inc. regarding your use of our site and purchases.

20. Giving Commitment

Our Giving Commitment

Simon Says Pet gives at least 50% of its net profit to dog rescue every year.

Net profit is what’s left after every cost of running the business is paid: products, shipping, overhead, our team, interest, and taxes. We figure it before any donations come out.

Our giving includes the blankets, leads, collars, and other essentials we donate to partner rescues and shelters, counted at what they cost us, plus any cash donations to partner rescues, shelters, and the Simon Says Foundation, a 501(c)(3) nonprofit founded by our founder.

Our item donations continue every year, whether or not we turn a profit.
